1. Concepts
– “Casa Roffa” or “Casa Roffa Maspalomas”: the holiday accommodation on Gran Canaria with the address: Calle la Gomera 61, 35100 Maspalomas.
– “Tenant”: the natural person who reserves and/or rents (part of) Casa Roffa for himself or herself and possibly others in a group in his or her name.
– “Lessor”: the owners of “Casa Roffa”.
2. General
The tenant who concludes the rental agreement is liable for all payments.
The property must be occupied by the tenant and his party/guests with the necessary care, taking into account the peace and quiet of the environment.
3. Reservations
A request for a reservation can be made:
– via our website: www.casaroffa.com
– by email: info@casaroffa.com
– by WhatsApp by sending a message to +31 6 51 98 40 70.
The tenant indicates for which period he wants to make a reservation.
He also indicates whether he wants to reserve the entire house or which room of Casa Roffa he wants to rent. By making a reservation, the tenant implicitly confirms that he has read, understood and agrees to the lessor’s terms and conditions and privacy policy.
The lessor then sends the tenant confirmation of the reservation by e-mail, after checking availability. This email contains, among other things, an overview of the amounts to be paid by the tenant, the associated deadlines and the IBAN number of the lessor.
The lessor then receives from the tenant:
– a copy of his valid passport (or comparable valid ID document), without BSN or other identification number
– his mobile number and his email address (if not yet known).
Only once the agreed amounts have been transferred by the tenant to the lessor’s account number will there be a binding rental agreement. Until then, the lessor can cancel the reservation without giving any reason. He will immediately refund any amounts already paid.
4. Payments
The tenant must pay an advance of 50% of the rental price to the lessor’s account within 5 days of receiving the confirmation email.
The tenant must clearly state the relevant confirmation number and the rental period when making payment.
The total amount to be paid must be credited to the lessor’s account no later than 14 calendar days before the start of the stay.
5. Failure to pay on time
If the tenant does not pay on time, the lessor will see this as cancellation of the rent by the tenant and the rental agreement will be terminated immediately.
6. Cancellation by tenant
Sometimes it happens that you have to cancel the booking. There are often costs involved. In many cases you can avoid these costs by taking out cancellation insurance in a timely manner.
The tenant can only cancel by sending an email to info@casarofffa.com. In this email he states the booking number and the reason for cancellation.
If tenant has booked a non-refundable rate, they will not be eligible for any refund.
In all other cases, the lessor will refund:
– 100% of the costs if the tenant cancels the booking via the aforementioned email within 48 hours of making the booking.
– 100% of the costs if tenant cancels more than 60 calendar days before the date of check-in.
– 50% refund of costs if cancelled between 30 and 60 calendar days before the check-in date.
– 25% refund of costs if cancelled between 14 and 30 calendar days before the check-in date.
In other cases, the lessor is not obliged to provide any refund.
Even in the event of early departure, the lessor is not obliged to make any refund.
No show
A “no show” occurs if the tenant has NOT physically reported to the lessor or his representative at the address of “Casa Roffa” on the agreed check-in date and time, and has also not informed the lessor in time about a possible delay.
The lessor sees a no show as cancellation of the rental by the tenant, as a result of which the rental agreement may be considered terminated with immediate effect.
7. Cancellation by lessor
If, due to unforeseen circumstances, the lessor has to cancel the rental and unilaterally terminates the rental agreement, the tenant will be immediately informed by email and payments made by the tenant will be refunded to the tenant by the lessor within 7 days.
8. Damage, loss and/or theft of tenant’s property
The lessor is not liable for any damage, loss or theft of property of the tenant, co-tenants and/or any guests. In the event of any disputes, all (legal) costs will be borne by the tenant.
9. Damage
The tenant is liable for all damage caused by him/her, co-tenants and/or any guests. Even if any damage is discovered after departure from the home.
All risks related to a stay at “Casa Roffa” are borne by the tenant.
The tenant immediately reports all damage to and/or missing items in “Casa Roffa” to the lessor. This can be done via WhatsApp or email.
The tenant will reimburse the lessor for the damaged and/or missing item(s) within 7 days after departure based on the replacement value in euros. The age of the item(s) in question is not taken into account. The lessor will send the tenant an invoice for the relevant costs.
10. Pets
Pets, other than those of the lessor, are not allowed in Casa Roffa (with the exception of certified service animals).
11. Check-in and check-out
Every guest must be able to identify themselves at check-in with a valid ID card or passport.
Check-in from 13:00 hrs on the day of arrival.
Check-out before 11:00 hrs on the day of departure.
Exceptions have to be agreed upon at least 24 hrs before arrival, and confirmed by email or WhatsApp.
12. Responsibility
The lessor cannot be held responsible for any disruption or inconvenience during the stay in the holiday home, if this is the result of unforeseen events. The lessor cannot be held responsible for inconveniences caused by the work of third parties, such as the municipality, province, etc. Nor can the lessor be held responsible for interruptions of water, electricity and internet if this is the result of force majeure.
The lessor declines any responsibility for loss, theft or damage to luggage, personal belongings or vehicle, and for costs resulting from failure to reach the holiday home on time. The lessor cannot be held responsible for accidents.
13. Complaints and disputes
A complaint about the holiday home will only be processed if it is reported to the lessor within 24 hours of taking possession of the holiday home. These (urgent) reports must be made to the lessor by telephone, followed by a confirmation by email. The same rule applies if something serious occurs during your stay in the holiday home.
If it is not possible to reach an agreement, the tenant must have the complaint verified by an expert, a bailiff or a notary in order to obtain an objective assessment.
14. Keys
When checking in, guests receive keys to Casa Roffa, which they return when checking out. The guests are all responsible for correctly locking both the front door and the gate on the patio of Casa Roffa.
If one or more keys are missing upon check-out, the lessor will replace the corresponding cylinders at the tenant’s expense.
The tenant will receive an invoice for the actual costs, which he will pay to the lessor within 7 calendar days.
15. Furthermore, the following house rules apply:
– Pets are not allowed (with the exception of certified service animals).
– We kindly request that you do not smoke in the house.
Smoking is allowed on the open patio and on the roof (ashtrays are available).
– The house is very private, but we do have neighbours. Please observe the ‘quiet hours’ between 11:00 pm and 8:00 am.
– Open fires or (large) barbecues are allowed everywhere in Casa Roffa (both inside and outside).
– Only after approval by the lessor are visitors (persons other than guests registered by the lessor) allowed to spend the night in Casa Roffa.
– Commercial events or noisy parties are not allowed in Casa Roffa without written permission from the lessor.
– Commercial photography or filming without written permission from the lessor is strictly prohibited.
